These Terms govern your access to and use of the Mercury AI services. By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Application.
1.1 Eligibility: You must be at least 13 years old to use the Mercury AI services. By using the Application, you represent and warrant that you are at least 13 years old.
1.2 User Account: To access certain features of the Application, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or suspected breach of security.
1.3 Prohibited Activities: You agree not to use the Mercury AI services for any unlawful purpose or in violation of these Terms. You also agree not to engage in any activity that could interfere with or disrupt the operation of the Application or the servers and networks connected to it.
2. Intellectual Property Rights
2.1 Ownership: The Mercury AI Application, including all content, features, and functionality, is owned by Mercury or its licensors and is protected by copyright, trademark, and other intellectual property laws.
2.2 Limited License: Subject to your compliance with these Terms, Mercury grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Mercury AI services for personal, non-commercial purposes.
2.3 Restrictions: You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Mercury AI services without prior written permission from Mercury.
3. Privacy
3.1 Privacy Policy: Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose information about you when you use the Mercury AI services. By using the Application, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

4.2 Limitation of Liability: To the maximum extent permitted by applicable law, Mercury shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use or inability to use the Mercury AI services.
5. Termination
5.1 Termination by Mercury: Mercury may, in its sole discretion, suspend or terminate your access to the Mercury AI services at any time and for any reason, without prior notice or liability.
5.2 Termination by You: You may terminate your use of the Mercury AI services at any time by uninstalling the Application and ceasing to use the services.
6. Governing Law and Dispute Resolution
6.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
7. Changes to the Terms
7.1 Modification: Mercury reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms on the Application.
